5 Legal Mistakes Florida Practices Make When Adding Telehealth

Adding telehealth looks like a technology decision: pick a platform, train the staff, open the schedule. For physician groups, clinics and multi-site operators, though, virtual care brings the same licensing, billing and fraud-and-abuse exposure as in-person care, and it adds a few risks of its own. These are the five mistakes we see most often in Florida, and how to avoid them.

1. Assuming Every Clinician Can See Every Patient

Florida’s telehealth statute, section 456.47, lets a telehealth provider perform patient evaluations remotely, and the provider and patient can be in different places. That permission applies only to people who qualify as telehealth providers under the statute. A clinician must be licensed in Florida, practice under a compact Florida participates in, or be registered as an out-of-state telehealth provider. flsenate

Registration comes with conditions. Registrants need qualifying malpractice coverage, a Florida registered agent and a practice within Florida’s scope of practice, and they may not open a physical office in Florida or provide in-person care to Florida patients. accountablehq

What to do: Build a credentialing check into scheduling. Before a clinician can be booked with a patient located in Florida, confirm their license, registration or compact status, and keep that record.

2. Treating Prescribing as an Afterthought

Prescribing rules shape which service lines are viable. Florida prohibits prescribing Schedule II controlled substances through telehealth, with limited statutory exceptions that you should check against the current statute before relying on them. flsenate

Federal rules add another layer. The DEA’s fourth extension lets DEA-registered clinicians keep prescribing Schedule II–V controlled substances without a prior in-person visit through December 31, 2026. That is a temporary flexibility. If your revenue plan depends on remote controlled-substance prescribing, you need a fallback in case the rules change. telehealth

What to do: List the medications each service line involves, map them to state and federal limits, and write a contingency plan for the end of the DEA extension.

3. Paying Marketers and Referral Sources Without Legal Review

Telehealth companies and practices adding virtual care often grow through affiliates, lead generators and partner referrals. Payment structures are where this goes wrong.

  • The federal Anti-Kickback Statute and Stark Law apply where federal health care programs are involved.
  • The Florida Patient Brokering Act is broader and can apply regardless of payor.
  • Fee-splitting rules in Florida’s professional practice laws can create licensing exposure for the clinicians involved.

Per-patient, per-visit or per-prescription fees to marketers deserve particular scrutiny. See our guide to the Florida Patient Brokering Act and referral arrangements.

What to do: Have counsel review every compensation arrangement with a marketer, affiliate or referral source before the first payment, not after a complaint or audit.

4. Getting the Ownership and Management Structure Wrong

A telehealth line often brings in new capital, a management company or non-clinician owners. Florida restricts who may own and control professional practices, and clinic licensing and fee arrangements can turn on how the entities relate to each other.

The common model pairs a management services organization with a professional entity owned by licensed practitioners. The details matter:

  • Clinical judgment must stay with licensed clinicians.
  • Management fees must be designed with fee-splitting rules in mind.
  • Your entity may need a license under the Health Care Clinic Act, or a documented exemption. See our overview of Florida Health Care Clinic Act licensing and exemptions.

Restructuring after launch is disruptive and expensive. It also surfaces in due diligence if you later sell the business or bring in investors.

What to do: Settle the structure before you raise capital or sign vendor contracts, and document why each exemption applies.

5. Relying on a Platform’s Compliance Claims

A vendor’s marketing page is not a compliance program. Your organization still needs:

  • A HIPAA risk analysis, written policies and workforce training
  • Business associate agreements with the platform, cloud host, billing company and other vendors that touch PHI
  • Breach-response procedures that account for Florida’s notification requirements
  • Contract terms on data ownership, uptime, indemnification and liability limits

What to do: Treat vendor selection as a legal review, not just an IT purchase, and keep the signed agreements and your risk analysis current.

A Note on Payer Coverage

If you bill insurance, check each payer’s current telehealth rules before projecting revenue. One payer notice reports that Medicare’s waiver of geographic and originating-site restrictions has been extended through December 31, 2027. Medicare policy has lapsed and been restored before, so confirm the current status with CMS guidance when you plan. azblue

The Bottom Line

Each of these mistakes is cheaper to prevent than to fix. Practices that settle licensure, prescribing, referral payments, structure and vendor contracts before launch spend less on cleanup and are easier to finance or sell later.
